The National Prosecuting Authority (NPA) will oppose bail for a 59-year-old teacher accused of raping a nine-year-old learner at Busisiwe Primary School in Zola, Soweto.

The accused, identified as Kabelo Temba, appeared in the Protea Magistrates’ Court on Thursday, 22 October 2026, facing a charge of rape. His case was postponed to 29 October for a formal bail application.

According to the NPA, the alleged incident took place in the school toilets on 6 October. The learner reportedly disclosed what had happened to her mother on the same day, while the matter was reported to the police on 10 October.

NPA spokesperson Magaboke Mohlatlole confirmed that Temba handed himself over to police on Wednesday, 21 October, before his court appearance the following day.

The state intends to oppose his release on bail, citing the seriousness of the allegation and the fact that the complainant is a minor.

Teacher Placed on Precautionary Suspension

The Gauteng Department of Education placed the teacher on precautionary suspension following the allegations.

The suspension came after parents protested outside Busisiwe Primary School, demanding action and raising concerns about how the allegations had been handled.

The protests brought attention to the case and prompted demands for accountability from those responsible for safeguarding learners at the school.

The department has also initiated psychological support for the nine-year-old learner to assist her following the alleged incident.

Parents Demand Accountability

Parents and members of the school community have expressed concern over the allegations and the circumstances surrounding the case.

The protests focused on the need for the allegations to be addressed and for appropriate action to be taken. The incident has also raised concerns about the safety of children in school environments and the responsibility of education authorities to respond appropriately when allegations of abuse are reported.

The allegations remain the subject of criminal proceedings. The accused has not been convicted, and the case must be determined through the courts.

Bail Application Scheduled for 29 October

Temba is expected to return to the Protea Magistrates’ Court on 29 October, when the formal bail application is scheduled to be heard.

The prosecution’s intention to oppose bail means the state will argue against his release while the criminal case proceeds. The court will consider the bail application in accordance with the law.

The NPA has reiterated its commitment to dealing with allegations of sexual offences against children seriously and ensuring that cases involving vulnerable complainants are handled with sensitivity and diligence.

The criminal case remains ongoing, and further developments are expected as the matter returns to court.
