Former professional footballer Mokete Sean “Shaune” Mogaila has been convicted in connection with the October 2024 road crash that claimed the life of nine-year-old Gomolemo Mavimbela in Tembisa, Gauteng. Mogaila appeared in the Tembisa Magistrates’ Court on 5 October 2026, where he pleaded guilty to charges arising from the fatal collision. The court subsequently convicted him. The case stems from a crash that occurred during the early hours of 30 October 2024 on Andrew Mapheto Road in Tembisa.
According to the facts placed before the court, Mogaila was driving when his vehicle left its path of travel, crossed into oncoming traffic and collided with another vehicle. The other vehicle was being driven by Keo Mavimbela and was carrying her daughter, Gomolemo, as well as 13-year-old Thando Khethiwa. Gomolemo died as a result of the collision.
Her mother and Thando survived but suffered serious injuries. Both required extensive medical treatment following the crash. Mogaila admitted responsibility for the collision in his plea statement, acknowledging that he had negligently caused or contributed to the crash in which Gomolemo sustained the injuries that resulted in her death.
He also admitted that he failed to render assistance to the injured people after the collision. Mogaila left the scene after the crash and later handed himself over to law enforcement authorities on the same day. The investigation into the incident subsequently formed the basis of the criminal case against him.
The National Prosecuting Authority confirmed that Mogaila’s guilty plea resulted in his conviction on the charges before the court. The conviction follows a lengthy legal process that included several court appearances and postponements.
A previous proposed plea and sentence agreement was rejected by the prosecution after representations were made on behalf of Gomolemo’s family and the family of Thando Khethiwa.
AfriForum’s Private Prosecution Unit has been assisting the affected families during the legal proceedings.
The organisation said the guilty plea spared the families the additional burden of having to endure a lengthy trial. The Mavimbela family has welcomed the conviction, although Gomolemo’s father, Tshepo Kekana, said the guilty plea could not erase the pain caused by the death of his daughter. Kekana said the family felt some relief that the case was finally moving forward after the lengthy legal process. Gomolemo’s mother, Keo Mavimbela, was also seriously injured in the collision. She has previously indicated that she wants the court to impose a direct prison sentence on Mogaila.
The family is now preparing a victim impact statement, which will be considered during the sentencing process. Victim impact statements allow the court to consider the consequences of an offence on those affected when determining an appropriate sentence. AfriForum’s Private Prosecution Unit said its focus would now shift towards assisting the families with those statements.
The organisation has also said that Mogaila’s guilty plea did not provide a complete explanation of everything that led to the crash.
Mogaila’s plea statement acknowledged that he lost control of the vehicle, which then crossed into the path of the oncoming vehicle.
Information presented during the broader investigation also indicated that alcohol bottles and substances were found inside Mogaila’s vehicle after the crash. The circumstances surrounding these findings formed part of the investigation and the evidence in the case.
Mogaila was a professional footballer at the time of the crash and had played for Sekhukhune United in South Africa’s top-flight football competition.
His football career continued while the legal proceedings were ongoing, although his contract with Sekhukhune United expired in July 2026.
The conviction means the matter has now moved from the trial stage to sentencing. Mogaila’s bail was extended following his conviction. The court postponed the matter to 17 November 2026, when sentencing proceedings are expected to take place.
The sentence will determine the legal consequences Mogaila will face following his conviction. For the Mavimbela family, the conviction marks a significant development in a case that has remained before the courts since the death of Gomolemo in October 2024.
The nine-year-old was travelling with her mother when the vehicles collided on Andrew Mapheto Road. Her death left her family dealing with the loss of a child while her mother and another young passenger continued to recover from serious injuries sustained in the same crash.

Man shot dead outside Cape Town primary school after dropping off child
A 31-year-old man was shot and killed outside Heatherdale Primary School in Athlone, Cape Town, shortly after dropping off his child on Tuesday morning.
The shooting happened on Belgravia Road, opposite the school, at about 7:40am on 6 October 2026.
According to police, the victim was inside a silver Hyundai Atos when unknown gunmen approached and opened fire. He sustained multiple gunshot wounds to his face and upper body and was declared dead at the scene by medical personnel.
Athlone police spokesperson Warrant Officer Zita Norman said several spent cartridges were found at the scene. Police said the attackers fled in an unknown vehicle and had not been arrested.
Provincial police spokesperson Lieutenant-Colonel Frederick van Wyk said the motive was believed to be gang-related and that Athlone police had opened a murder case.
Police said the deceased was believed to be a member of the Junky Funky Kids (JFK) gang. Norman said investigators believed the shooting was linked to an ongoing conflict between the JFKs and the Fancy Boys.
The shooting took place as learners returned to school, with the attack occurring directly opposite the primary school shortly after the victim had dropped off his child.
The Western Cape Education Department said support had been made available at the school following the incident.
Safe Schools and psychosocial support personnel were deployed to assist staff and learners, while counselling was offered to people who may have witnessed the shooting or its aftermath. The department said teaching and learning continued as scheduled.
Crime scene experts examined the area for evidence as police began investigating the circumstances surrounding the killing.
No arrests had been reported at the time of the latest police updates.

Missing person search ends with murder arrest after body recovered from Inchanga cliff
The search for a missing person in Inchanga, KwaZulu-Natal, has ended with the discovery of a body and the arrest of a suspect on charges including murder, kidnapping and defeating the ends of justice.
The deceased has been identified as 32-year-old Kwanele Ngcobo, who had been missing for almost a month before his body was located at the bottom of a cliff in the Inchanga area.
The search operation was launched after police requested assistance from Magma Security and Investigations in locating Ngcobo.
A joint operation involving PMB Crime Intelligence, SAPS Mountain Rise, SAPS Inchanga, Durban K9 Search and Rescue, PMB Search and Rescue, and Magma Security and Investigations was subsequently conducted in the area.
Search teams worked through difficult terrain as they attempted to locate the missing man. Police search-and-rescue personnel and K9 units were involved in the operation, with additional resources used to assist the search.
Ngcobo’s body was eventually located at the bottom of a cliff and recovered by rescue personnel.
The discovery led to a murder investigation as police worked to establish the circumstances surrounding his disappearance and death.
Ngcobo had been reported missing after his family was unable to locate him. A missing-person case was opened at Mountain Rise police station on 21 September.
The investigation subsequently led search teams towards the Inchanga area, where the body was found.
Police also investigated information relating to an alleged housebreaking incident at a property in Copesville. Investigators are examining whether the incident could assist in establishing what happened to Ngcobo.
Following the recovery of the body, one suspect was arrested in connection with the investigation.
The suspect is expected to appear in the Pietermaritzburg court on Wednesday, 7 October 2026, where he is expected to face charges of murder, kidnapping and defeating the ends of justice.
A pistol was also recovered during the operation.
The outcome of the operation was:

- One firearm recovered
The investigation remains ongoing as police work to establish the full circumstances surrounding Ngcobo’s disappearance and death.
The suspect remains innocent until proven guilty and will have an opportunity to respond to the allegations through the court process.
